Welcome to Kemark.lk, Sri Lanka’s fast growing online shopping mall, owned and operated by Kemark holdings Pty LTD .The following document explains the terms and conditions applicable to your use of Kemark.lk. By using www.kemark.lk (hereinafter called and referred to as “kemark.lk”, “website” or the “Site” or “ us”), you agree to these conditions. Please read them carefully. Access to and use of this Website and the products and services available through this Website (Products and the Services) are subject to the following terms, conditions and notices. By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You are responsible for informing yourself of any changes by regularly reviewing these pages. If you access the website after changes are posted, you are taken to have accepted such changes.

When you visit the Site or send e-mails to us, you are communicating with us electronically. You thereby consent to receive communications from us electronically. The “kemark.lk” and the “kemark” trademarks and/or trade names may only be associated with its products and services and may not be used in connection with any other products and/ or services, in any manner that is likely to cause confusion among customers, or in any manner that disparages kemark.lk. All other trademarks not owned by Kemark.lk or its Partners or its vendors/merchants that appear on this Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Kemark.lk, its vendors or its Partners.
All content included on this Site, such as text, graphics, logos, button icons, images, , digital downloads, and software, is the exclusive property of kemark.lk, its Partners or its vendors/merchants and such content is protected under the Intellectual Property Act of Sri Lanka No 36 of 2003.

SITE ACCESS AND REGISTRATION

In order to access the Site, you are required to register a user account with a valid log in email address and password. In order to register a user account in the manner required, you must provide all information requested including your full name, telephone number, mobile number, Email address, residential address and relevant company details. All information provided must be true, accurate, current and complete. Incomplete, ineligible or incomprehensible user account registrations will be deemed invalid. You agree to maintain up-to-date Registration Data.
You are responsible for maintaining confidentiality of your user account login and password, and you are responsible for any activity under your account and password. You should agree to:
• Change your password in case of unauthorized access to your account.
• Also make sure that you exit from your user account at the end of each session. It is your responsibility to control the dissemination and use of your password and control access to and use of your account.
• We will not be responsible or liable for any loss or damage arising from your failure to comply with this provision.
• Kemark.lk have the right to refuse any requests to register new user accounts in our sole discretion. Without limiting the above, this includes but is not limited to refusing requests for suggested user logins which are the same as or similar to existing user logins or are inappropriate, offensive, obscene, abusive, and logins which infringe copyright  or contain names such as high profile or public figures or names promoting political, religious, social or economic issues. In creating your user account, you must not intentionally use the name of another living person.
• We will not accept any user account that we suspect is being made by or on behalf of a person who has been suspended from the site for breach of the web site terms and conditions.

TERMINATION

We may terminate your User account at any time for any reason.Kemark.lk reserves the right to immediately, without notice or reason, suspend or terminate your access to the Service any time. Your registration information or any other information you provided to us during registration process will be deleted or discard. We reserve the right take legal actions for your breach of law or Agreement.

FEES AND SERVICES

The List Price displayed for products will be as quoted on our Site from time to time, except in cases of obvious error.
The price for each product but exclude shipping costs, which will be added to the total amount due once you have selected the delivery location from the available options.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

We accept credit/debit card payments (Visa, Master, AE), Ez Cash, MCash, Cash on Delivery (COD)  and Bank Transfer.
In the case of Credit/Debit Card payments, MCash or EzCash payments, you will receive an order confirmation and payment confirmation via an e-mail.

If you have selected COD method of payment, the goods will be dispatched upon pending payment. You will be expected to settle the invoice in full to the delivery person who is responsible for collecting the cash from the customer and transfer it to kemark.lk. We cannot complete your order until you have paid for the product in full. You cannot cancel the order or refuse to pay when the product/s are delivered to you after your confirmation.

You can pay for your product/s by depositing the total amount to our bank account or by doing a bank transfer using the online banking facilities provided by your bank. If you do a bank deposit, please take a photo of the bank deposit slip and e-mail it to us at payments@kemark.lk. If you do a bank transfer, please e-mail us the screenshot of the transaction as well the transaction ID. Once we successfully receive the details, we will process your order.

INFORMATION COLLECTION

Kemark.lk knows that you care how the information about you is used and shared, and we appreciate your trust and want you to feel confident in our products and services and security as it relates to your personal information.
We respect your privacy and will never sell, rent, lease or give away your information (name, address, email, etc.) to any third party for their marketing purposes.
We do not keep Financial information (such as credit card number and expiration date) and they are only used for the service you are purchasing.
All your personal information is password and as a registered user, you will be able to edit or delete your personal information details at any time using your own ID and password.
Kemark.lk takes reasonable measures (physical, organizational and technological) to safeguard against unauthorized access to your personal information and to safely store your personal information. However, you acknowledge that the Internet is not a secure medium where privacy and confidentiality can be guaranteed and that complete security and confidentiality of transmissions to and from this site over the Internet is not possible at this time. Your confidential use of this site cannot be guaranteed and you acknowledge that your use of this site (including information you transmit to the site) may be subject to access or manipulation by, or disclosure to, third parties. Without limiting any other disclaimer herein, kemark.lk and its affiliates shall not be responsible or liable for any damages that you or any other person may suffer in connection with any such breach of privacy, confidentiality or security.

DELIVERY INSTRUCTIONS AND ADVICE

Deliveries are made during business hours on Monday to Friday. Delivery time is generally 3 to 5 business days, however times could vary depending on the merchant/supplier and kemark.lk cannot be held liable for any delays.
To ensure prompt delivery someone must be present to sign for the parcel. If no-one is available to sign for the parcel, or if its incorrect address our delivery company will leave a contact card with instructions for customer to call and the parcel is returned to us. The cost of returning the product which will be passed on to the customer. We will contact you via the telephone number you have provided or via an e-mail to take further actions.
Please remember there will be a re-delivery fee apply for this type of an issue. So double check the shipping and delivery address before you place the order to avoid any extra delivery charges. We will try our best to contact you to double check all orders before processing the order once payment is completed online.

RETURN POLICY

Products purchased from Kemark.lk cannot be returned unless there is a fault or damage occur to the product during the delivery or there is a manufacture defect in the product.
When you receive the product that was bought and paid through Kemark.lk, and you find it is a faulty product, please call our customer care within 12 hours with the order ID in your hand.
We will reimburse you for the cost of returning the package to us, and we will not charge you for the shipping costs of replacing the goods.
We do not accept "change of mind" exchanges or refunds for items purchased on kemark.lk

LIABILITY

kemark.lk Board of directors, employees, agents or any other third parties involved in our website is not liable for any losses, personal injury, illness, death, claims, liabilities or expenses of any kind, including legal fees that arise out of or in connection with the buying of products and services through our website.

RISK OF LOSS

All the products purchased from kemark.lk are made pursuant to a delivery contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

UNAVAILABILITY OF PRODUCT

As a user you should understand and agree that kemark.lk merely acts as an intermediary between the customer and the supplier to advertised products on our web site. Also all products advertised are not managed or maintained by kemark.lk.
Sometimes some products may be not available on the web site due to overselling by the suppliers but the product may be available for purchase on kemark.lk because the supplier has not promptly informed us about fact that the product is unavailable for them to supply us. In such circumstances kemark.lk does not accept any liability whatsoever.
If the product is out of stock in such circumstances the customer will get notify about the product unavailability within 48 hours and will get a full refund within 5 working days.
